1. Legal Entity & Acceptance of Terms

These Terms of Service ("Agreement") constitute a legally binding agreement between you ("Client," "User," or "Customer") and LProductions Ltd, a company registered in the Republic of Mauritius, doing business as MusHost ("Company," "we," "us," or "our").

By signing up for, accessing, or using any services provided by MusHost—including web hosting, domain registration, web development, design, and streaming solutions—you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Services Provided

LProductions Ltd provides the following services through its MusHost division:

  • Web Hosting: Shared, VPS, and Dedicated server environments.
  • Domain Registration: Registration and management of domain names.
  • Web Development & Design: Custom website creation, UI/UX design, and maintenance.
  • Streaming Hosting: Audio and Video streaming servers (e.g., Icecast, SHOUTcast).

3. Account Eligibility & Security

  • Age: You must be at least 18 years of age to register for our services.
  • Accuracy: You agree to provide accurate, current, and complete contact information.
  • Security: You are responsible for maintaining the confidentiality of your account credentials (usernames and passwords). LProductions Ltd is not liable for any loss or damage arising from your failure to protect your account security.

4. Acceptable Use Policy (AUP)

You agree NOT to use MusHost services for:

  • Illegal Activities: Hosting content that violates the laws of Mauritius or the jurisdiction where the server is located.
  • Malicious Content: Distributing malware, viruses, trojans, ransomware, or other harmful code.
  • Phishing & Fraud: Hosting "phishing" sites, fraudulent investment schemes, or identity theft tools.
  • Copyright Infringement: Storing or distributing files (music, video, software) for which you do not have the legal copyright or license.

5. Email Usage & Zero-Tolerance Spam Policy

To protect our IP reputation and ensure reliable email delivery for all clients, MusHost strictly enforces the following:

  • No Spam: The sending of Unsolicited Commercial Email (UCE) or "SPAM" is strictly prohibited.
  • Opt-In Only: All mailing lists must be Double Opt-In. You must be able to provide proof of permission for every recipient on your list.
  • Blacklisting: If your account causes a MusHost IP address to be blacklisted (e.g., Spamhaus, Barracuda), we reserve the right to suspend or terminate your service immediately without refund.
  • Volume Limits: Shared hosting accounts are subject to hourly email sending limits. High-volume senders must use a VPS or a dedicated 3rd-party email transaction service.

6. Streaming Hosting Regulations

  • Licensing: You are solely responsible for obtaining necessary licenses for the content you broadcast (e.g., MASA in Mauritius, SACEM, etc.). LProductions Ltd claims no ownership over your content and accepts no liability for copyright claims against your station.
  • Resource Usage: Clients must adhere to the bitrate and listener limits specified in their purchased package.
  • Content: Broadcasting hate speech or illegal content will result in immediate termination.

7. Web Development & Design Terms

  • Ownership: Upon full payment of all invoices, the Client owns the final visual design and specific source code created for their project. LProductions Ltd retains the right to reuse generic code libraries and snippets.
  • Revisions: The project quote includes a specific number of revisions. Additional work outside the original scope will be billed at our standard hourly rate.
  • Credit: We reserve the right to place a small text link ("Designed by MusHost") in the footer of the website, unless a "White Label" fee is paid.

8. Payments, Renewals & Refunds

  • Billing Entity: All invoices and charges will appear on your bank statement as LProductions Ltd.

  • Payment Terms: Services are billed in advance. Invoices are due upon receipt or by the specified due date.

  • Late Payments & Suspension: Failure to pay by the due date may result in immediate service suspension.

  • Reactivation Fees: If your account is suspended due to non-payment, you will be required to pay the outstanding balance plus a reactivation fee of Rs 500 before services can be restored.

  • Data Deletion & Non-Recovery: Following account suspension, MusHost reserves the right to permanently delete all server content (including files, databases, and emails) at any time without prior notice.

  • Reactivation Risks: If you choose to pay the reactivation fee after data deletion or domain expiration has occurred, we do not guarantee the recovery of your previous website content or the availability of your domain name.

  • Refund Policy:

    • Hosting: We offer a 30-day money-back guarantee for new shared hosting accounts.
    • Non-Refundable: Domain registrations, SSL certificates, and custom Web Development/Design fees are non-refundable once the service/work has commenced.

9. Limitation of Liability

LProductions Ltd shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, or for the cost of procurement of substitute services.

  • Backups: While we perform routine server backups, the Client is solely responsible for maintaining their own off-site backups. We are not liable for data loss.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Mauritius. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Mauritius.
